Failure to Transfer Possession in Bangladesh
(1) If the aggrieved person does not receive possession of the property within fifteen (15) days of the issuance of an order under Section 8 of the Land Crime Prevention and Remedies Act, 2023, the Executive Magistrate shall have the authority to enforce the transfer. In such cases, the Magistrate may issue an order directing law enforcement agencies to take necessary action to reinstate possession to the applicant, in accordance with the guidelines set out in Appendix-8.

(2) Upon receiving the order specified in sub-rule (1), the appointed officer shall proceed with the execution of the possession transfer. Once the transfer is complete, the officer must formally notify the applicant. Additionally, the concerned Land Assistant Officer shall prepare a possession handover document following the format prescribed in Appendix-9. This document shall be submitted to the Executive Magistrate, and a copy shall be provided to the applicant for their records.

(3) In situations where the applicant expresses unwillingness or inability to take possession of the property, the District Magistrate may intervene. If deemed necessary, the District Magistrate may assign another Executive Magistrate to oversee the matter and issue appropriate directives to the law enforcement agencies to ensure compliance with the order.

Responsibilities and Costs for Possession Reinstatement in Bangladesh
(4) If the process of reinstating possession requires additional measures—such as the placement of boundary markers, installation of signboards indicating the rightful possession holder’s name, erection of fences, or deployment of equipment and personnel—the applicant shall be responsible for arranging these materials. The applicant must also bear all associated costs, subject to the prior approval of the Executive Magistrate.

(5) To facilitate the possession reinstatement process, the Executive Magistrate may assess and determine the necessary expenses involved. If required, the Magistrate may take appropriate measures to collect these costs from either the applicant or the respondent and ensure payment to the designated personnel or agency responsible for executing the transfer.

(6) If an individual or group unlawfully occupying the property obstructs the possession reinstatement process, the Executive Magistrate shall take appropriate legal action. The Magistrate may formally report specific allegations against the obstructing party to the appropriate criminal court. Additionally, if necessary, the Magistrate may initiate mobile court proceedings to address the violation and enforce compliance effectively.
