To safeguard individuals from unlawful eviction or dispossession, the law provides a structured legal framework for reclaiming possession of previously occupied land. This document outlines the procedure and guidelines for a dispossessed person to seek reinstatement of possession through the designated\u00a0<strong>Executive Magistrate<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Application for Reinstatement of Possession in Bangladesh<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>(1)<\/strong>\u00a0In accordance with\u00a0<strong>Section 8<\/strong>\u00a0of the Land Crime Prevention and Remedies Act, 2023, if an individual has been forcibly evicted or unlawfully dispossessed from their occupied land without a valid court order or authority approval, they may submit an application to the designated\u00a0<strong>Executive Magistrate<\/strong>. The application must be supported by relevant documents and follow the provisions outlined in\u00a0<a href=\"https:\/\/legalseba.com\/bd-articles\/all-the-legal-forms-for-possession-claims-in-bangladesh\/\"><strong>Appendix-5<\/strong>.<\/a><\/p>\n<p style=\"font-weight: 400;\"><strong>(2)<\/strong>\u00a0Upon receipt of the application, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0shall review the supporting documents, including original copies or certified copies. If the documents are found to be authentic, the Magistrate shall:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Validate them with an official seal and signature.<\/li>\n<li>Attach them to the application.<\/li>\n<li>Provide the applicant with a certified copy.<\/li>\n<li>Return the original documents to the applicant.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong>(3)<\/strong>\u00a0If the application and supporting documents are deemed insufficient, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0shall record the reasons for rejection and specify that no further applications shall be entertained based on the same documents.<\/p>\n<h3><\/h3>\n<ol start=\"3\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Investigation and Report Submission<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>(4)<\/strong>\u00a0If the submitted application and documents are found valid, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0shall:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Issue a formal\u00a0<strong>notice to the Respondent<\/strong>\u00a0within\u00a0<strong>15 (fifteen) working days<\/strong>, in accordance with\u00a0<a href=\"https:\/\/legalseba.com\/bd-articles\/all-the-legal-forms-for-possession-claims-in-bangladesh\/\"><strong>Appendix-6<\/strong>.<\/a><\/li>\n<li>Direct the\u00a0<strong>Investigating Officer<\/strong>\u00a0to conduct an inquiry and submit a detailed report within\u00a0<strong>15 (fifteen) working days<\/strong>.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong>(5)<\/strong>\u00a0If the investigation cannot be completed within the stipulated period, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0may extend the deadline by an additional\u00a0<strong>15 (fifteen) working days<\/strong>, upon receiving a formal request from the\u00a0<strong>Investigating Officer<\/strong>.<\/p>\n<p style=\"font-weight: 400;\"><strong>(6)<\/strong>\u00a0The\u00a0<strong>Investigating Officer<\/strong>\u00a0shall:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Serve notice to the\u00a0<strong>Respondent<\/strong>, providing all relevant evidence and documents submitted by the complainant.<\/li>\n<li>If land measurement is required, seek assistance from the\u00a0<strong>concerned land office<\/strong>.<\/li>\n<li>Examine and collect copies of records, documents, and other relevant information from any necessary office.<\/li>\n<\/ul>\n<h3><\/h3>\n<ol start=\"4\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Re-Investigation and Hearing Process<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>(7)<\/strong>\u00a0If any party is dissatisfied with the investigation report submitted by the\u00a0<strong>Investigating Officer<\/strong>, they may file an appeal with the\u00a0<strong>Executive Magistrate<\/strong>\u00a0requesting a\u00a0<strong>re-investigation<\/strong>. The\u00a0<strong>Executive Magistrate<\/strong>\u00a0has the discretion to order a fresh investigation if deemed necessary.<\/p>\n<p style=\"font-weight: 400;\"><strong>(8)<\/strong>\u00a0The\u00a0<strong>Executive Magistrate<\/strong>\u00a0shall ensure that the\u00a0<strong>notice under sub-rule (4)<\/strong>\u00a0is duly served for the hearing. During the hearing, the Magistrate shall:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Consider the legal arguments and evidence presented by the applicant, respondent, and their legal representatives.<\/li>\n<li>Evaluate the credibility of the submitted statements and documents.<\/li>\n<\/ul>\n<h3><\/h3>\n<ol start=\"5\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Issuance of Reinstatement Order<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>(9)<\/strong>\u00a0If, after reviewing all submitted documents, statements, and the\u00a0<strong>Investigating Officer\u2019s report<\/strong>, it is determined that the applicant was lawfully occupying the land and has been\u00a0<strong>illegally evicted or dispossessed<\/strong>, the\u00a0<strong>Executive Magistrate <\/strong>shall:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Issue an\u00a0<strong>order for reinstatement<\/strong>\u00a0or\u00a0<strong>restoration of possession<\/strong>\u00a0of the land.<\/li>\n<li>Follow the procedures outlined in\u00a0<a href=\"https:\/\/legalseba.com\/bd-articles\/all-the-legal-forms-for-possession-claims-in-bangladesh\/\"><strong>Appendix-7<\/strong>\u00a0<\/a>for execution of the order.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong>(10)<\/strong>\u00a0If the notice under\u00a0<strong>sub-rule (4)<\/strong>\u00a0is not served within the specified time, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0shall proceed with the case based on the applicant\u2019s complaint, application, documents, and the\u00a0<strong>Investigating Officer\u2019s report<\/strong>.<\/p>\n<h3><\/h3>\n<ol start=\"6\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Special Powers of the Executive Magistrate<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\"><strong>(11)<\/strong>\u00a0The\u00a0<strong>Executive Magistrate<\/strong>\u00a0may invoke the provisions of the\u00a0<strong>Right to Information Act, 2020 (Act No. 11 of 2020)<\/strong>where applicable to obtain necessary information and records for the case.<\/p>\n<p style=\"font-weight: 400;\"><strong>(12)<\/strong>\u00a0For the purpose of resolving land disputes, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0may:<\/p>\n<ul style=\"font-weight: 400;\">\n<li>Examine and collect copies of land records, documents, and any other relevant materials kept in government or private offices.<\/li>\n<li>Conduct independent verification of the land records.<\/li>\n<\/ul>\n<p style=\"font-weight: 400;\"><strong>(13)<\/strong>\u00a0The\u00a0<strong>Executive Magistrate<\/strong>\u00a0may appoint temporary\u00a0<strong>bailiffs, messengers, or process servers<\/strong>\u00a0for case-specific tasks such as serving notices and summons.<\/p>\n<p style=\"font-weight: 400;\"><strong>(14)<\/strong>\u00a0In disputes involving law and order concerns, the\u00a0<strong>Executive Magistrate<\/strong>\u00a0may issue direct orders to the\u00a0<strong>Officer-in-Charge of the relevant police station<\/strong>\u00a0to take necessary measures to prevent any breach of peace.<\/p>\n<h3><\/h3>\n<ol start=\"7\">\n<li style=\"font-weight: 400;\">\n<h3><strong> Conclusion<\/strong><\/h3>\n<\/li>\n<\/ol>\n<p style=\"font-weight: 400;\">These guidelines ensure a structured legal approach to reinstating dispossessed individuals in possession of their lawfully occupied land.
