For cross-border matters, three further ideas do most of the heavy lifting.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <\/p>\n<h3>Domicile, not residence<\/h3>\n<p><!-- [et_pb_line_break_holder] -->      <pee>Living abroad does not, by itself, change a person's <em class=\"term\">domicile<\/em> &mdash; the country a person treats as their permanent home and intends to return to. A Bangladeshi on a work visa in London may remain Bangladesh-domiciled; a naturalised citizen who has put down permanent roots may have acquired a foreign domicile. This distinction decides whether a Bangladeshi court can even hear certain petitions, and whether a foreign decree will be respected.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <\/p>\n<h3>Foreign divorce validation: how recognition works under Section 13 CPC<\/h3>\n<p><!-- [et_pb_line_break_holder] -->      <pee>Bangladesh has no bespoke statute for recognising foreign matrimonial decrees. Section 14 adds a presumption that a certified copy of a foreign judgment was pronounced by a competent court, unless the contrary is shown.<!-- [et_pb_line_break_holder] -->      <\/div>\n<p><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <pee>Translated to a divorce, this means a foreign decree will normally be respected where the deciding court had competent jurisdiction (typically because at least one party was domiciled there), the matter was decided on its merits with both sides given a fair hearing, there was no fraud, and the outcome does not offend Bangladeshi public policy or the parties' own personal law. A divorce obtained on a flying visit, with no real jurisdictional connection or without notice to the other spouse, is the classic case that fails these tests.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <\/p>\n<h3>Registration is proof, not magic<\/h3>\n<p><!-- [et_pb_line_break_holder] -->      <pee>Registering or recording a divorce &mdash; whether before a Nikah Registrar (Kazi) under the <strong>Muslim Marriages and Divorces (Registration) Act 1974<\/strong> or by collecting a divorce certificate from the Union Parishad or City Corporation &mdash; produces the evidence you will need for remarriage, inheritance, passport and immigration purposes. The governing instruments are the <strong><a class=\"inline\" href=\"http:\/\/bdlaws.minlaw.gov.bd\/act-details-305.html\" target=\"_blank\" rel=\"noopener\">Muslim Family Laws Ordinance 1961<\/a> (MFLO)<\/strong>, the <strong><a class=\"inline\" href=\"http:\/\/bdlaws.minlaw.gov.bd\/act-details-180.html\" target=\"_blank\" rel=\"noopener\">Dissolution of Muslim Marriages Act 1939<\/a><\/strong>, and the <strong><a class=\"inline\" href=\"http:\/\/bdlaws.minlaw.gov.bd\/act-details-476.html\" target=\"_blank\" rel=\"noopener\">Muslim Marriages and Divorces (Registration) Act 1974<\/a><\/strong>, with the <strong>Family Courts Act 2023<\/strong> (which repealed and replaced the Family Courts Ordinance 1985) supplying the court machinery.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <\/p>\n<h4 class=\"ls-scn\">Scenario A <span class=\"ls-tag\">Divorce from abroad<\/span><\/h4>\n<p><!-- [et_pb_line_break_holder] -->      <pee>A talaq can be initiated from overseas. The husband pronounces talaq and then complies with the formality that actually makes it effective in Bangladesh: written notice to the relevant Chairman or Mayor, with a copy to the wife.<\/pee><!-- [et_pb_line_break_holder] --><!-- [et_pb_line_break_holder] -->      <\/p>\n<div class=\"ls-statute\"><!-- [et_pb_line_break_holder] -->        <b>Section 7, MFLO 1961<\/b><!-- [et_pb_line_break_holder] -->        A man who divorces his wife must give the Chairman of the Union Parishad (or Mayor of the City Corporation\/Municipality) written notice as soon as may be after pronouncing talaq, with a copy to the wife. The talaq does not take effect until <strong>ninety days<\/strong> after the Chairman receives that notice (or, if the wife is pregnant, until the pregnancy ends), during which an Arbitration Council attempts reconciliation. The 1974 Registration Act expressly applies to <strong>all Muslim citizens of Bangladesh wherever they may be<\/strong>, so the divorce can and should be registered.<\/pee><!-- [et_pb_line_break_holder] -->      <pee>Where a couple has obtained a divorce from a <em>foreign court<\/em>, recognition follows the private-international-law tests above. Under the uncodified <a class=\"inline\" href=\"https:\/\/legalseba.com\/bd-articles\/hindu-marriage-and-divorce-laws-in-bangladesh\/\">Hindu personal law still applied in Bangladesh<\/a>, marriage is a <strong>sacrament, not a contract<\/strong> &mdash; and a sacrament cannot be undone.
